Local Manufacturing Company Prevails in Insurance Declaratory Judgment Action; Award of Attorneys’ Fees and Expenses Obtained

Attorneys Patrick S. Casey, Sandra M. Chapman, and Ryan P. Orth of Casey & Chapman, PLLC, prevailed, including an award of attorneys’ fees and expenses, on behalf of a local manufacturing company in a complex insurance declaratory judgment action brought by its insurer in the United States District Court for the Northern District of West Virginia to avoid coverage obligations in underlying latent exposure matters. The Court awarded summary judgment to the manufacturing company, and on appeal, the manufacturing company prevailed before the United States Court of Appeals for the Fourth Circuit and on a certified question to the Supreme Court of Appeals of West Virginia. Following the conclusion of the appellate process, the Court granted the manufacturing company’s petition for attorneys’ fees and expenses and awarded the manufacturing company the entirety of its attorneys’ fees and expenses incurred in its defense, plus interest.
