Summary Judgment Granted in Insurance Declaratory Judgment Action

Casey & Chapman, PLLC, successfully obtained summary judgment on behalf of a local manufacturing company in the United States District Court for the Northern District of West Virginia in a complex insurance declaratory judgment action brought by its insurer seeking to avoid coverage obligations in underlying latent exposure matters. The Court found in favor of the manufacturing company in adopting the continuous or multiple trigger of coverage theory and found that the insurer owed a continuing duty to defend in each of the latent exposure matters.
